Important: Please read these Terms of Service carefully before using CampMate. By accessing or using our service, you agree to be bound by these terms. If you do not agree to these terms, you may not use CampMate.

1Acceptance of Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you", or "your") and CampMate ("Company", "we", "us", or "our") governing your access to and use of our camping packing guidance platform and related services (collectively, the "Service"), including the website at campmateapp.com and the Google Play listing that opens that site in a Trusted Web Activity.

By creating an account, accessing, or using any part of the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you are using the Service on behalf of an organization, you represent and warrant that you have the authority to bind that organization to these Terms.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email and in-app notification at least 30 days prior to taking effect. Your continued use of the Service after changes become effective constitutes acceptance of the modified Terms.

2Eligibility and Account Registration

Age Requirement: You must be at least 13 years of age to use CampMate. Users between 13 and 18 must have parental or guardian consent. By using the Service, you represent and warrant that you meet these age requirements.

Account Creation: To access certain features, you may be required to create an account. You agree to provide accurate, current, and complete information during registration and to update such information to keep it accurate, current, and complete.

Account Security: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to immediately notify us of any unauthorized access or use of your account. We will not be liable for any loss or damage arising from your failure to protect your account credentials.

One Account Per User: You may only create and maintain one account. Creating multiple accounts to circumvent restrictions or abuse the Service is prohibited and may result in account termination.

3License and Restrictions

Limited License: Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use.

Restrictions: You agree NOT to:

  • Copy, modify, distribute, sell, or lease any part of the Service
  • Reverse engineer, decompile, or attempt to extract source code from the Service
  • Use the Service for any illegal, unauthorized, or commercial purpose without express permission
  • Interfere with or disrupt the Service, servers, or networks connected to the Service
  • Attempt to gain unauthorized access to any portion of the Service or other systems or networks
  • Use automated systems (bots, scrapers, crawlers) to access the Service without permission
  • Remove, alter, or obscure any proprietary notices (copyright, trademark, etc.) from the Service
  • Use the Service to transmit viruses, malware, or other malicious code
  • Harass, abuse, or harm other users of the Service
  • Impersonate any person or entity or misrepresent your affiliation with any person or entity

4User Content and Intellectual Property

Your Content: You retain all ownership rights to the content you create, upload, or share through the Service ("User Content"), including trip plans, packing lists, notes, and other data.

License to Us: By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, store, reproduce, modify, and display your User Content solely to provide, maintain, and improve the Service. This license terminates when you delete your User Content or account, except for content shared with other users or retained in backups (which will be deleted within 30 days).

Content Responsibility: You are solely responsible for your User Content. You represent and warrant that you own or have necessary rights to your User Content and that it does not violate any third-party rights, laws, or these Terms.

Public content and collaboration: Private packing lists are visible only to you until you publish a template, enable a share link, or invite a collaborator. You must accept these Terms before making content visible to others. You can Report public content or Block another user from their profile, template, shared list, or the Campers list. Reports are reviewed by CampMate at hello@campmateapp.com. Blocking hides that person's public content from you and is not disclosed to them.

Affiliate links: Shopping and product links, including Amazon search links, may be affiliate links. CampMate may earn a commission if you buy through those links, at no extra cost to you.

Our Intellectual Property: The Service, including its design, features, graphics, text, code, and trademarks, is owned by us or our licensors and protected by copyright, trademark, and other intellectual property laws. Our trade names and trademarks may not be used without our prior written consent.

Disclaimers and Limitation of Liability

Service "AS IS": THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR COURSE OF PERFORMANCE. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

Information Accuracy: While we strive to provide accurate information, we do not warrant the accuracy, completeness, or usefulness of any information on the Service. Trip setup suggestions, packing lists, and recommendations are for informational purposes only and should not be relied upon as professional advice.

Outdoor Safety: CAMPMATE IS A PACKING TOOL ONLY. WE ARE NOT RESPONSIBLE FOR YOUR SAFETY OR WELL-BEING DURING OUTDOOR ACTIVITIES. You are solely responsible for your own safety, readiness, and decisions when camping or engaging in outdoor activities. Always check local conditions, regulations, and weather forecasts, and use appropriate safety equipment.

Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL CAMPMATE, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM:

  • Your access to or use of or inability to access or use the Service
  • Any conduct or content of any third party on the Service
  • Any content obtained from the Service
  • Unauthorized access, use, or alteration of your transmissions or content

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, OR CAUSES OF ACTION EXCEED THE AMOUNT YOU HAVE PAID US IN THE LAST SIX (6) MONTHS, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS GREATER.

Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability for incidental or consequential damages. In such jurisdictions, our liability will be limited to the greatest extent permitted by law.

6Indemnification

You agree to indemnify, defend, and hold harmless CampMate, its officers, directors, employees, agents, licensors, and suppliers from and against all claims, losses, expenses, damages, and costs, including reasonable attorneys' fees, arising out of or relating to:

  • Your use of or inability to use the Service
  • Your violation of these Terms
  • Your violation of any rights of another party, including any other users
  • Your User Content or any content you post or share on or through the Service
  • Any harm or damages caused by your outdoor activities or trips planned using the Service

We reserve the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which event you will cooperate with us in asserting any available defenses.

7Termination and Suspension

Termination by You: You may terminate your account at any time through the Settings page or by contacting us at hello@campmateapp.com. Upon termination, your right to use the Service will immediately cease.

Termination by Us: We reserve the right to suspend or terminate your account and access to the Service, with or without notice, for any reason, including but not limited to:

  • Violation of these Terms or our policies
  • Fraudulent, abusive, or illegal activity
  • Extended periods of inactivity
  • Requests by law enforcement or other government agencies
  • Discontinuation or material modification of the Service

Effect of Termination: Upon termination, all licenses and rights granted to you will immediately cease. We will delete your account data within 30 days of termination, except as required by law or to protect our legitimate interests. Provisions of these Terms that by their nature should survive termination shall survive, including ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

8Dispute Resolution and Arbitration

Informal Resolution: Before filing a claim, you agree to contact us using the information below and attempt to resolve the dispute informally. We will attempt to resolve disputes through good faith negotiations for at least 30 days.

Binding Arbitration: If we cannot resolve a dispute informally, any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be settled by binding arbitration administered by a recognized arbitration organization, in accordance with its rules. Arbitration will be conducted on an individual basis; class arbitrations and class actions are not permitted.

Exceptions: Either party may seek equitable relief in court for infringement or other misuse of intellectual property rights without first engaging in arbitration or the informal dispute resolution process.

Governing Law: These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which CampMate is registered, without regard to its conflict of law provisions.

Note: Some jurisdictions do not allow certain dispute resolution mechanisms. If you are located in such a jurisdiction, the above provisions may not apply to you, and disputes will be resolved in accordance with applicable local laws.

9General Provisions

Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and CampMate regarding the Service and supersede all prior agreements and understandings.

Severability: If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

Waiver: No waiver of any term of these Terms shall be deemed a further or continuing waiver of such term or any other term, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision.

Assignment: You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Any attempted transfer or assignment in violation hereof shall be null and void.

Force Majeure: We shall not be liable for any failure to perform our obligations where such failure results from any cause beyond our reasonable control, including but not limited to mechanical, electronic, or communications failure or degradation, natural disasters, or acts of war or terrorism.

Third-Party Services: The Service may contain links to third-party websites or services that are not owned or controlled by CampMate. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party websites or services.

BY CLICKING "I ACCEPT," CREATING AN ACCOUNT, OR USING CAMPMATE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT ACCESS OR USE THE SERVICE.
